Restructuring and De-Registration

Restructuring

Reorganizing the legal , ownership, or strategic structure of a company may result in better profitability, prevent probability of fraudulent activity, or may be mandatory as a response to a crisis or major change in the rules and regulations of the country or industry.

Corporate restructuring may also be connected to debt, and financial restructuring to save or reposition the company and reduce financial loss.

Executives involved in the restructuring need qualified financial and legal advisors to assist in the transition, and identify the strengths and risks for negotiations purposes.

ARCA has advised many entities in relocating or restructuring due to wrong decisions of previous advisers / officers to establish in unsuitable locations or in wrong status throughout the existence since 1979 all over UAE.

Liquidation

ARCA has been appointed by many companies as well as by the Courts as registered liquidators – according to UAE Federal Commercial Companies Law, liquidation section.

Few examples of liquidations ARCA ‘s experts carried, are ETARAT (which had over 32,000 shareholders) FOUR CATERING SERVICES, and SHIRA’A MARINE INVESTMENTS COMPANY

ARCA has helped smaller companies get deregistered -both inside UAE and at the Free Zones- with the least possible liquidation damages and costs protecting all stakeholders’ rights.

A great example of a recent liquidation law is the Dubai International Financial Centre (DIFC) which has its own complete modern set of laws and all relevant regulations and courts. ARCA’s Managing Partner, Munem AlRubaie is also registered at DIFC as liquidator.
